Americans for IVF Submits Comprehensive Recommendations to Trump Administration to Expand Affordable Access to IVF and Fertility Care

Comments Applaud Historic Proposed Rule While Urging Additional Steps to Ensure Millions of Americans Can Build Their Families

WASHINGTON, D.C. — Americans for IVF (AIVF) has made recommendations to the Trump administration on its proposed rule allowing standalone health coverage for fertility care, seeking to maximize access to affordable care, including in vitro fertilization (IVF), for millions of Americans.

In a comprehensive comment letter to the Departments of Labor, Treasury, and Health and Human Services regarding the proposed “Excepted Fertility Benefits” rule, AIVF praised this historic and innovative step that advances President Trump’s commitment to expanding access to fertility treatment. The organization also urged the Departments to ensure the final rule clearly includes IVF, encourages broad insurer participation, extends the framework to the individual market, and is implemented as quickly as possible.

The letter further recommends that the Administration actively engage major health insurers—similar to its successful TrumpRx initiative—to encourage voluntary adoption of meaningful fertility coverage and overcome pricing and market barriers that could otherwise limit participation. AIVF is the only organization pushing for this innovative approach. 

AIVF also highlights data showing that broad IVF coverage will add only an estimated 58 cents per member per month to health premiums when spread across a broad risk pool.

We believe that, with thoughtful refinements and strong engagement with the insurance industry, this rule can transform access to fertility care and give countless families hope where today there is too often heartbreak.”

“From a physician’s perspective, timely access to fertility care is critical. It is heartbreaking when unnecessary delays in diagnosis or treatment significantly reduce a patient’s chances of success, potentially ruining their dreams of having children,” said Dr. Kaylen Silverberg, Chairman of the AIVF Advisory Board. “We commend the administration for recognizing the importance of fertility care and urge that IVF remain a central component of the final rule, as it is an essential pillar of modern fertility treatment. When patients have access to evidence-based treatment, they experience better outcomes, and the healthcare system benefits through safer, more efficient care.”

Among AIVF’s recommendations are:

  • Clarify that IVF is fully included in the new excepted fertility benefit category.
  • Finalize the rule with the earliest possible effective date.
  • Extend the framework to the individual insurance market.
  • Encourage national and regional insurers to voluntarily offer meaningful fertility benefits.
  • Clarify that treatment of infertility-related medical conditions, including endometriosis and male-factor infertility, is included when medically appropriate.
  • Maintain the proposed $120,000 lifetime benefit limit and preserve employer flexibility in plan design.

The comment letter also notes that infertility affects millions of Americans and emphasizes that, for many patients, IVF is not elective care but the only realistic path to having biological children. It argues that expanding fertility coverage strengthens families, improves workforce participation, supports mental health, and contributes to the nation’s long-term demographic and economic health.

The submission concludes by reaffirming AIVF’s commitment to working closely with the Administration, physicians, employers, insurers, and policymakers to ensure that the promise of the proposed rule becomes meaningful, affordable access to fertility care for families across the United States.
