Public Urged to Submit Comments by July 13 on Rule That Could Help Employers Offer Up to $120,000 in Lifetime Fertility Benefits

WASHINGTON, D.C. — Building on millions invested over the past two years in legislative advocacy, public affairs, strategic communications, and grassroots engagement, Americans for IVF today launched its latest nationwide advocacy campaign in support of a federal proposal that could reshape access to fertility benefits for millions of Americans. The organization also announced that it stands ready to invest hundreds of thousands of additional dollars to support this effort through digital advertising, public education, coalition building, and grassroots mobilization.

“We’re not sitting on the sidelines,” said Dr. Kaylen Silverberg, Chairman of the AIVF Advisory Board. “We’re investing millions of dollars in advocacy, public education, digital outreach, and coalition building because the cost of inaction is measured in families who never get the chance to have a child.”

The campaign calls on patients, families, employers, health care providers, and advocates to submit public comments before the federal deadline of July 13, in just five days, emphasizing what supporters describe as a rare opportunity for the public to help shape national fertility policy.

“Our message is simple: Americans who dream of becoming parents deserve access to affordable fertility treatment,” Dr. Silverberg added. “This proposed rule represents one of the most significant federal fertility initiatives in recent history. Now is the time for patients, physicians, employers, and supporters across the country to feel empowered to make their voices heard.”

According to AIVF, the Department of Labor’s proposal could create new opportunities for employers to offer substantial fertility benefits separate from traditional group health coverage, potentially reducing financial barriers that prevent many individuals and couples from pursuing treatment.

“This is exactly how the regulatory process is supposed to work,” Dr. Silverberg said. “The Administration has asked for public input, and we want to ensure that the voices of families struggling with infertility are heard clearly and respectfully.”

With the public comment period now open, AIVF has launched a national outreach initiative encouraging supporters to participate in the federal rulemaking process by submitting comments online. The organization notes that public comments play an important role in helping federal agencies evaluate the impact of proposed regulations before they are finalized.

“Federal policy doesn’t change overnight, but it does change when people speak up,” Dr. Silverberg added. “Every comment represents another family, another patient, another employer saying that fertility care should be more affordable and accessible.”

In addition to mobilizing public participation, AIVF has submitted its own comprehensive comment letter to the Departments, offering detailed legal, policy, actuarial, and clinical recommendations to strengthen the final regulation.

The organization is urging supporters nationwide to submit comments before July 13, when the comment period closes.
